Oregon defensive back Daylen Austin pleads not guilty to alleged felony hit and run

Oregon’s defensive backIn the alleged felony hit-and-run event that claimed a man’s life in April of last year, Daylen Austin filed a not guilty plea.

At a hearing in Lane County Circuit Court on Tuesday morning, Austin, 20, was formally arraigned. He was charged with a Class B felony last month for failing to carry out the responsibilities of a motorist when someone else is hurt. The trial was moved to August 14 from its original date of last week.

Tuesday morning also saw a hearing on a demand for pretrial production of Frank William Seaman’s medical records, who was killed by Austin’s SUV on April 15.

Austin’s lawyer, Bryan Boender, stated that before issuing an order on the application, Lane County Circuit Court Judge Stephen Morgan is awaiting word of Seaman’s next of kin.

Seaman’s medical and mental health records, according to Boender’s motion filed earlier this month, are favorable evidence that more fully explains his aggressive mental state at the time he threatened Daylen Austin with a hammer prior to the fatal incident near the intersection of West Fourth Avenue and Polk Street. They also provide context for Austin’s reasonable fear and fear, which prevented him from staying at the scene.
